Periodic Inspection of Parking Structures (PIPS)

New to the list of Local Law Units at NYC DOB is the formation of the “Parking Structures” unit. Proposed under Local Law 126 of 2021, the latest addition to the NYC Construction Codes §28-323 and creation of RCNY §103-13 addresses the requirements to regularly inspect and repair Parking Structures, as needed, as defined by the NYC Building Code.

Who Must Comply?


Parking Structures that must comply:

● A building or a portion of a building used for parking or storing motor vehicles, including space inside or under a building.

● Open parking garages and enclosed parking garages as defined in the NYC Building Code.


Parking Structures that are EXEMPT:

● An auto body/automotive repair shop, an automotive showroom, or an automotive service station. 

● A garage with occupancy of fewer than three cars.

● Unenclosed and unattached lots.

● Garages serving one- and two-family homes.



Condition Assessment Report and Classification :

 

Starting in the 2022 Calendar year, owners of these Parking Structures must hire a Qualified Parking Structure Inspector (QPSI), a DOB Approved New York State licensed and registered Professional Engineer (PE), to Inspect and File a Condition Assessment Report at least once every six (6) years, which will classify the Parking Structure in a similar process familiar to FISP.

 

The following classifications of the conditions are as follows:

 

●     Safe: No problems and in good condition


●     Safe With Repairs and/or Engineering Monitoring (SREM): Safe, but requires repair/monitoring


●     Unsafe: Problems/defects threaten public safety. With an Unsafe classification, the owner shall immediately secure public safety by removing the unsafe condition or safeguarding the area.


Filing Windows per Sub-Cycle

The Parking Structures filing timeframe is subdivided into three sub-cycles “A, B, or C” based on the Community District the Parking Structure’s location lies in. The breakdown of the first cycle is shown below:

"A" Manhattan Community Districts 1, 2, 3, 4, 5, 6, 7 January 1, 2022 - December 31, 2023
"B" Manhattan Community Districts 8, 9, 10, 11, 12 and Brooklyn Community Districts January 1, 2024 - December 31, 2025
"C" Bronx, Queens, and Staten Island Community Districts January 1, 2026 – December 31, 2027
